Lawyers for Adairs to review records

YOUNGSTOWN

Attorneys for Scott and Linda Adair, accused of embezzling nearly $1 million from Southwind Trucking Inc., want more time to review the company’s corporate records.

The Adairs, of Canfield, are accused of embezzling from Southwind Trucking Inc. of Austintown between March 1, 2004, and Oct. 31, 2007.

Scott Adair was co-owner of the company at the time.

After closed-door pretrial discussions Tuesday, Kenneth J. Cardinal, assistant Mahoning County prosecutor, said Judge Lou A. D’Apolito of Mahoning County Common Pleas Court approved a request from the Adairs’ lawyers to access the following Southwind Trucking records:

Documents held by the prosecutor’s office.

Bank statements.

Check copies.

Disbursement records.

Records supporting disbursements, including purchase orders.

Credit-card statements.

QuickBooks computer files.

Financial statements.

Federal income-tax records.

Cardinal said he thinks the documents will prove to be unnecessary to the case but agreed to the extension in the name of full disclosure.

“We added a pretrial to give them the opportunity to look at some corporate records,” he said. “We don’t believe those documents will lead to any discovery of new evidence.”

Cardinal said the defense already has everything he intends to introduce as evidence at trial.

“We’ve given them all the documents the prosecutor’s office believes are relevant to the indictment,” he said.

A new pretrial hearing date was set for 11 a.m. Feb. 11.
