Lawyers argue rights to review Oakhill case filings

An attorney for Anthony M. Cafaro Sr., one of the seven people accused of participating in a criminal conspiracy involving the Oakhill Renaissance Place, argued today The Vindicator doesn’t have an “absolute right” to review documents related to the case.

Martin G. Weinberg, Cafaro’s attorney, questioned the fairness of the coverage by the newspaper in this case.

The argument comes as The Vindicator and WFMJ-TV Channel 21 seek to unseal pretrial documents files in the case.

To avoid pretrial publicity he said could bias potential jurors, Visiting Judge William H. Wolff Jr. ordered all non-routine documents in the case to be filed under seal so he can review them before deciding if all or part should be made public.

“To be clear, my clients’ rights have been violated,” said Marion H. Little Jr., attorney for the newspaper and TV station.
