Harassment conviction overturned

A Pennsylvania appeals court has overturned the harassment conviction of a Bridgeville man who left angry voice mail with a borough manager about a noisy cement plant.

The Superior Court on Wednesday said that Marshall Pappert was exercising his constitutional right to petition the government.

Bridgeville police charged Pappert with harassment in October 2007 after he left the message on the borough manager’s answering machine. He was convicted of harassment in July 2008 and fined $300.

Pappert was assisted in his appeal by the American Civil Liberties Union. He says he’s ecstatic with the decision of the appeals court.
