David P. Aey, who was disqualified in his 2008 run against Mahoning County Sheriff Randall Wellington because he didn’t meet the state’s educational requirements to run for sheriff, will return to work Sunday as a deputy.

An arbitrator ordered Aey reinstated to his job but did not order back pay for him.

Aey, of Boardman, who will earn $42,355 annually, will be in the headquarters pool and will be assigned as needed to courthouse security and inmate transportation, Wellington said.

A month from now, he will be able to bid on a work assignment by seniority, the sheriff said.

Aey could not be reached to comment.

Aey, whose last assignment was courthouse security, took a one-year leave of absence to run against Wellington, followed by a second one-year leave of absence.

Wellington sought to bar Aey from returning, saying the Fraternal Order of Police contract didn’t permit two consecutive leaves of absence, but the arbitrator, Howard Silver, ordered his reinstatement, saying the contract language is vague.
