Man acquitted in murder of 12-year-old Pa. boy
PITTSBURGH (AP) — A jury today acquitted a Pittsburgh man accused of opening fire on a street and indirectly causing the death of a 12-year-old boy who fled the gunfire.
The lawyer for 20-year-old Donald Wilson, also known as “Tank,” argued that his client was a victim of mistaken identity and wasn’t the one who opened fire on the street in Wilkinsburg.
The victim, Kholen Germany, ran into a clothing store when the gunfire erupted on April 18, 2008. He was shot and killed by 25-year-old Kevin Johnson of Pittsburgh’s Homewood section. Johnson testified that he thought he was shooting at Wilson. He testified for the prosecution against Wilson.
Prosecutors maintained that Wilson started the chain of events that led to Germany’s death and he should be convicted of third-degree murder.
