Biros continues to fight death penalty

COLUMBUS (AP) — A man who killed a woman and left her body parts in Ohio and Pennsylvania is asking the Ohio Supreme Court to ignore a prosecutor’s request to set his execution date.

Kenneth Biros argues in a court filing Monday that he remains a party in a federal lawsuit challenging Ohio’s lethal injection system.

The 50-year-old Biros also argues he was not properly indicted under Ohio’s capital punishment law and shouldn’t have received a death sentence.

The Trumbull County prosecutor asked the court last month to set an execution date.

Though Biros remains part of the injection lawsuit, a federal judge ruled that Biros didn’t prove the system is unconstitutional.

Biros killed 22-year-old Tami Engstrom near Warren in 1991 after he offered to drive her home from a bar.
