Judge sends case of two charged in drive-by shooting to grand jury


WARREN — Judge Thomas Gysegem ruled the state had presented sufficient evidence to bind over murder charges against two men to a Trumbull County grand jury.

The judge’s ruling came after a preliminary hearing today in municipal court. The hearing showed some of the evidence the Warren Police Department and prosecutors will use to try to prove that Eugene Henderson and Eugene Cumberbatch committed murder and that Marcus Yager committed complicity to murder.

Yager’s case was sent to the grand jury last week.

The drive-by shooting on April 13 at a home on Wick Street Southeast that killed Marvin Chaney, 26, almost immediately, and mortally wounded Lloyd McCoy Jr., 11, who died April 21 in St. Elizabeth Health Center.
