The grand jury issued a superseding indictment against Reginald Everson.

YOUNGSTOWN — The Mahoning County grand jury has issued a superseding indictment against one of three defendants in the robbery and murder of Edward Agee, a clerk at the Auto Zone on McCartney Road, more than three years ago.

The superseding indictment returned Thursday adds an aggravated murder charge with a firearm specification against Reginald Everson, 23, of Chalmers Avenue, who previously was charged only with aggravated robbery.

Two other defendants in the May 2, 2006, Auto Zone robbery and murder, Melvin T. Dixon Jr., and Jamaad Jackson, were initially indicted on charges of aggravated murder and aggravated robbery with firearm specifications. Dixon was additionally charged with illegal gun possession.

Although they said a store video showed Jackson, 20, of Wychwood Lane, was armed, police believe Dixon, 25, of Devon Avenue, actually shot Agee, 52, of Star Street. Everson, who was arrested in the Los Angeles area, did not have a gun during the Auto Zone robbery, an assistant prosecutor said when Jackson was indicted in August 2007.

Paul J. Gains, county prosecutor, declined to comment on the specifics of the case late Thursday.

In an unrelated case, Everson was charged with murder in the shooting death of Terrell L. Roland, 18, who was shot twice in his East Avondale Avenue driveway in the spring of 2008. That shooting occurred while Everson was free on a $15,000 bond in the Auto Zone case. After Roland’s death, a municipal judge raised Everson’s bond to $1 million.
