UPDATED: Gutierrez, former Dann aide, pleads guilty to theft in office, other charges

COLUMBUS (AP) — A top aide to former Ohio Attorney General Marc Dann has pleaded guilty to theft in office, unauthorized use of state property and other charges.

Anthony Gutierrez entered the pleas today to six of 10 charges that largely involved allegations related to his former business, MTV Construction of Liberty.

As part of his plea deal, Gutierrez agrees to cooperate with further investigations of Dann. Attorneys also have recommended that he serve 45 days in jail – served in 15-day stints – and to make restitution. He also will have to pay restitution to the state Bureau of Workers' Compensation.

He will be sentenced Oct. 14.

Gutierrez of Liberty was at the center of a scandal that led Dann to resign last year. Two women working in the attorney general’s office accused Gutierrez of sexually harassing them, and he was fired.

The plea agreement was announced Monday in a Franklin County courtroom. Gutierrez entered his pleas just as jury selection was to begin in his trial.
