Physician in sex-for-drugs case sentenced to 90 days at WASP


WARREN — Dr. Mark E. Davis of Howland, an osteopath with an office on state Route 193 in Vienna, was sentenced to 90 days in the Warren Alternative Sentencing Program and five years’ probation and was ordered to pay restitution for giving drugs to patients in exchange for sex.

Davis, 47, of Brittany Oaks Trail, received his sentence Tuesday from Judge Andrew Logan in Trumbull County Common Pleas Court. Judge Logan ordered the physician to pay restitution of more than $14,000 to the Ohio Board of Pharmacy. He also received a six-month driver’s license suspension and was ordered to stay away from illegal drugs and to submit to random drug testing.

Davis pleaded guilty earlier to two counts of drug trafficking after he was caught on videotape writing a prescription for Schedule 3 drugs to a confidential informant in exchange for sex.

The incidents with the confidential informant occurred after complaints were received by the pharmacy board, which conducted an investigation, said Gina Arnaut, an assistant Trumbull County prosecutor.

Davis has been licensed as an osteopath since August 1988 and has a specialization in family medicine, according to the Ohio Medical Board Web site. His practice is in the Vienna Medical Arts Clinic, 341 Youngstown-Kingsville Road, the Web site says.

The Warren Alternative Sentencing Program is housed in the former Warren City Jail. In it, offenders are kept at night but allowed to leave for work or treatment appointments.
