Turning Technologies wins ruling

YOUNGSTOWN — Turning Technologies said it has received a favorable ruling in a patent battle with a competitor.

The Youngstown-based company said Monday that Judge Peter Economus of U.S. District Court has ruled in the company’s favor in establishing how the patent claims will be defined. A hearing had taken place in January.

Mike Broderick, Turning Technologies chief executive, said the ruling was “very favorable” to the company’s position. The matter still will be set for trial, but Broderick said he hopes it can be settled before then.

“This ruling reinforces our belief that we have a very strong case and strengthens our resolve to enforce and defend our intellectual property wherever necessary,” he said.

The suit was filed last year against Holtzbrinck Publishers and MacMillan Publishers, who produce a device called I Clicker. Turning Technologies said this device violates a patent that covers the communication method used by its response card.

Both companies produce units that are used to poll people in classrooms or corporate training sessions.
