The Ohio Supreme Court has once again ordered the Mahoning County Board of Elections to not permit David P. Aey to run for county sheriff.

In a 5-2 decision today, the court said the board of elections “abused its discretion” by permitted Aey to run for sheriff as a write-in candidate.

“Aey has not established his eligibility to be a write-in candidate for sheriff,” the decision reads.

The court had earlier disqualified Aey as a sheriff candidate in the Democratic primary stating he didn’t meet the qualifications to run.

Sheriff Randall Wellington, a Democrat, filed both appeals to the Supreme Court.

With Aey out, Wellington is the only sheriff candidate.
