Landfill companies sue Hubbard and other officials


HUBBARD — Trans Rail America and Sienna Place Inc. have filed a lawsuit in federal court against township officials and others, claiming they were illegally denied zoning permits that are required to operate.

Trans Rail and Sienna are both located at 6251 Chestnut Ridge Road. Trans Rail America wanted to build a landfill on Mount Everett Road, according to Vindicator files.

The civil lawsuit was filed Wednesday in U.S. District Court in Youngstown. It names township trustees, planning and zoning commission and board of zoning appeals; Trumbull County Planning Commission; Hubbard Environment & Land Preservation; U.S. Rep. Tim Ryan, D-17th; state Sen. Capri S. Cafaro; Marc Dann, former Ohio Attorney General; Ohio Environmental Protection Agency; and Bennett and Williams, Environmental Consultants Inc.

The lawsuit alleges the defendants acted in concert with the intent to harm the plaintiffs’ businesses and property.

Trans Rail wants compensatory damages of $16.5 million and Sienna wants $75,000. They also want punitive damages — $50 million for Trans Rail and $1 million for Sienna.
