Aey back in court over ballot

YOUNGSTOWN — A complaint was filed in federal court this afternoon on behalf of David Aey, the independent candidate for Mahoning County sheriff knocked off the ballot by the Ohio Supreme Court because he lacks sufficient education.
Aey’s attorney, David C. Comstock Jr., asks the federal court to allow Aey to remain eligible as a write-in candidate until the issue of the constitutionality of the law that governs college credit is resolved. The complaint asks that a temporary restraining order and preliminary injunction barring counting of the ballots be ordered until the conclusion of the case.
The case has been assigned to U.S. District Judge Peter C. Economus.
