Boy will be tried as juvenile in killing


MEDIA, Pa. (AP) — A Delaware County judge says a boy accused of fatally stabbing his older brother over a video game should be tried as a juvenile.

The defendant was 13 at the time of his brother’s stabbing death and is now 14.

Judge Frank Hazel says the boy lacks “the maturity or level of sophistication” of an adult, or even of other juveniles he’s housed with in the county prison.

It was unclear if prosecutors would appeal Hazel’s order, which was made public Monday.

If the boy had been convicted of first-degree murder in adult court, he would get life without parole. If convicted as a juvenile, he can be held only until he is 21.
