YOUNGSTOWN — Mahoning County Sheriff Randall A. Wellington’s request to have his opponent disqualified should be dismissed because of procedural errors with his legal filings, an attorney representing the county contends.

Wellington’s lawyer doesn’t agree, but she filed a request Wednesday with the Ohio Supreme Court to withdraw the original motion and filed an amended one “to resolve and correct any technical errors, real or imagined, in order to allow a full adjudication on the merits of this important dispute.”

Donald J. McTigue of Columbus, hired to represent the county board of elections, brought up the procedural issues in Jan. 29 and Monday responses to Wellington’s filing with the Supreme Court.

The court should dismiss Wellington’s complaint because he failed to include a court-required affidavit that supported his claims and specified the details of the case, McTigue wrote.
