Settlement terms

Key provisions of the lawsuit settlement between Mahoning County and Ohio:

The Wilson Avenue overflow in Campbell must be eliminated by June 30, 2013.

From now until 2016, Mahoning County must send the Ohio Environmental Protection Agency an annual written report assessing the effectiveness of its efforts to reduce and eliminate the flow of storm and underground water to its sanitary sewer system.

The county will pay a $150,000 fine to be derived from sewer user fees to the Ohio attorney general’s office in four annual $37,500 installments.

The county will complete construction of a new sewer system for 121 homes in East Alliance by Aug. 1, 2011.

The county will pay fines up to $1,000 a day for violation of environmental regulations concerning wastewater discharge.
