Ohio EPA lawsuit alleges company runs illegal hazardous waste dump

LISBON — The Ohio Environmental Protection Agency is seeking thousands of dollars in penalties from people it says have been running an illegal hazardous waste dump since at least 2003.

The case was filed Thursday in Columbiana County Common Pleas Court by the state attorney general’s office, which represents the OEPA.

The lawsuit contends that the owners and operators of S R Recycling Inc. of Brewster, N.Y., have been running a construction and demolition landfill, which can take plaster, wood and other items.

The landfill is located at U.S. Route 30 and state Route 644 in Kensington.

But the state says the landfill also has been taking hazardous wastes.

The agent for the company in Ohio is Lloyd W. Berresford Jr. of Hanoverton.

The defendants include Simone DiPasquale of Patterson, N.Y.; Romeo Maffei of Mamaroneck, N.Y.; Melvin Toalson of Moorings- port, La.; and Frances C. Toalston, also of Mooringsport.

DiPasquale is the president and half-owner. Maeffi is the operator who owns the other half. The Toalsons are the former owners who sold the land to SRR in 2002, but the lawsuit says they had an ownership in the property and took part in the alleged improper dumping.
