WARREN — Anthony Gutierrez, a supervisor fired from the Ohio Attorney General’s Office after an internal investigation determined he sexually harassed two female subordinates, faces four income-tax related charges in Warren Municipal Court.

Gutierrez, 50, of Liberty, is scheduled to appear Aug. 27 before Magistrate Dan Gerin.

Each offense carries with it a maximum $500 fine and six months in jail.

Gutierrez, who is married, was fired May 2 by then-Attorney General Marc Dann, a neighbor and longtime friend, as the office’s director of general services.

Dann subsequently resigned under pressure May 14. The resignation came as the partial result of the sexual harassment investigation that also concluded Dann ran an office with a hostile work environment and filled with cronyism.

Dann, who also is married, admitted he had an extramarital affair with one of his employees.

Gutierrez could not be reached to comment and did not return a message left at his home.

The tax violation charges were filed May 14, the same day Dann resigned, by Tom Gaffney, city tax administrator.

Gaffney said the charges against Gutierrez have nothing to do with the scandal in the attorney general’s office.

According to the complaints filed by Gaffney, Gutierrez is charged with not filing tax returns in 2006 and 2007 and not withholding taxes from his employees during the fourth quarter of 2006 and all of 2007. Gutierrez owned MTV Construction LLC.

The address for MTV and Gutierrez are the same at 607 Northlawn Drive.

Gaffney said MTV was involved in work at Arthur Treacher’s on Elm Road and Caf 422 on Youngstown Road. The amount of taxes owed is not known, he added.

Gaffney said that in such tax cases, defendants usually file the returns and pay the arrearage. The charges are then dismissed.

If the defendant can’t pay in a lump sum, a payment plan is devised and the person is placed on probation until the debt is paid, he added.
