Jury rules against woman who sued estate


WARREN — A jury has ruled against a Warren woman who sued the estate of her dead fiancé for injuries she received while riding on the back of a motorcycle with him in 2003.

The jury trial held this week was the result of a lawsuit filed by Elaine M. Krause against Lois E. Stitt of Hubbard, administratrix of the estate of Keith M. Stitt.

Krause was a passenger on Keith M. Stitt’s motorcycle, which was struck by a deer Oct. 8, 2003, on Warren-Sharon Road in Brookfield.

Previous court documents have said Stitt slowed to around 25 or 30 miles per hour after seeing a herd of deer along the side of the road and seeing one of the deer cross in front of him. A second deer then crossed in front, striking the motorcycle.

The filings said Stitt could have done more to avoid the crash, such as pull over. She sought monetary compensation for her injuries.

The jury disagreed, charging legal costs to Krauss.
