Vukovich sits as justice

COLUMBUS — Judge Joseph J. Vukovich of the Youngstown-based 7th District Court of Appeals will serve as a visiting Ohio Supreme Court justice today. Judge Vukovich will sit in place of Justice Maureen O’Connor, who has removed herself from Talik vs. Federal Marine Terminals Inc. The case, which originated in Cuyahoga County, examines whether a federal workers’ compensation act pre-empts Ohio case law that allows an injured worker to file an “intentional tort” claim against his employer in cases where a workplace condition was so unsafe that it presented a “substantial certainty” of worker injury. Ohio Supreme Court justices don’t give reasons when they remove themselves from cases, a high court spokeswoman said.

Turner election campaign

NEWTON FALLS — Newton Falls Municipal Court Judge Larry Turner will kick off his campaign for election to complete the last four years of a six-year term from 5:30 to 7 p.m. Wednesday at the Brew Basket Cafe and Gifts, 44 West Broad St. Turner is a Republican who was appointed to the position by then-Gov. Bob Taft in September 2006 to fill the unexpired term of Judge Thomas L. Old, a Democrat. If not elected this November, Turner, of Lordstown, will serve until the results of the November 2007 election are certified by the county board of election. If elected in November, he will serve the remainder of Old’s term, until the end of 2011. Turner’s opponent in November is Democrat Atty. Philip M. Vigorito of Lordstown. Neither candidate will have a party designation next to his name on the November ballot because judicial general election races are nonpartisan even though there are partisan primaries for those positions.
