OVI | Penalties
Operating a Vehicle Impaired is a first-degree misdemeanor and has a standard range of penalties of 180 days jail and/or $1,000 fine. For a second offense refusal for taking a blood-alcohol test, there are mandatory minimum penalties. They are:
Twenty days in jail or 10 days jail and 36 days electronically monitored house arrest.
Fine of $350.
Accused attends driver intervention program.
License suspension (1 to 5 years).
Driving privileges after 30 days. (Mandatory restricted license plates if granted.)
90-day vehicle immobilization.
