Citizen seeks to halt Youngstown park vote
YOUNGSTOWN — A citizen is asking the Ohio Supreme Court to stop the city from putting charter amendments overhauling the park and recreation commission on the November ballot.
Terrence P. Esarco of East Midlothian Boulevard filed suit Monday with the state’s highest court questioning the legality of city council’s Sept. 5 vote in favor of the amendments.
If the Supreme Court agrees the legal action has merit, Esarco's attorney said he and city attorneys would argue the case before the Nov. 6 election.
During a Sept. 5 meeting, council went into executive session for the stated purposed of pending litigation. After emerging from the meeting, among the legislation approved by council was one impacting park and recreation operations.
City officials at the executive session insist the issue was ironed out before that private meeting. They also say the amendments weren’t discussed during the executive session.
