MERCER COUNTY | Sentencings


Mercer County Common Pleas judges sentenced these people to prison, jail or probation. Case summaries are from court documents:

Thomas Kelley, 26, of Columbia Avenue, Greenville, sentenced to 28 months to 12 years in prison for two felony counts of statutory sexual assault. Between 2000 and 2004, he engaged in sexual intercourse with a girl who was between the ages of 7 to 10 years old in Pymatuning Township.

Shawn Kilpatrick, 27, of Hartwick Road, Mercer, sentenced to 18 months to three years in prison for terroristic threats, two counts of simple assault and recklessly endangering another person. Kilpatrick pressed a pistol against another man’s throat Aug. 6, 2000, at a Pine Township address.

Susan Mathieson, 33, of Scrubgrass Road, Mercer, placed on one year’s probation and ordered to make restitution for theft by deception. On Nov. 17, 2006, she wrote a check for $150 to a Springfield Township business knowing the check would not be honored.

Calvin Norris, 19, formerly of Woodrow Court, Sharon, and now of the Mercer County Jail, sentenced to one to 21⁄2 years in jail for causing an accident involving death or personal injury, causing an accident involving death or personal injury while not properly licensed and receiving stolen property, all felonies, and two misdemeanor counts of recklessly endangering another person. On Feb. 13, 2007, Norris tried to injure a Sharon policeman by ramming his vehicle into a police cruiser that was trying to stop Norris, who was driving a stolen car and driving under suspension. Norris struck a utility pole, injuring his male passenger.

Donald Raiti, 34, of South Oakland Avenue, Sharon, sentenced to 234 days in jail followed by probation for felony arson and misdemeanor disorderly conduct. He was given 234 days credit for time served. He intentionally started several fires at a South Pymatuning Township mobile home, scuffled with a woman as she tried to put out one of the fires, refused to obey a police command to come out of the mobile home when it was on fire requiring an officer to push him, and threatening to kill police officers.

John W. Rice, 26, formerly of Greenville and now of the Mercer County Jail, sentenced to 57 months to 10 years in prison for felony sexual assault. In September and October 2006 he engaged in sexual intercourse with a 9-year old girl and also had indecent contact with her in a Greenville residence.

Raymond Sharbutt, 20, of First Avenue, Sharon, resentenced to one to two years in prison for felony burglary. On Feb. 9, 2006, he was sentenced to six to 18 months in jail followed by 18 months’ probation. He violated his probation by having new criminal charges brought against him.

Peggy Hodge, 48, of Plum Street, Greenville, was placed in the state Intermediate Punishment Program for two felony counts of possessing cocaine with the intent to deliver. On Dec. 10, 2005, she delivered 1.3 grams cocaine to another person at a North Water Street, Hermitage address. Then on July 15, 2006, she was apprehended at her residence with cocaine.

Ronald Mazon, 47, of Glenn School Road, Sandy Lake, sentenced to six to 23 months in the Mercer County Jail for involuntary manslaughter. On June 11, 2005, Mazon backed across Glenn School Road, Mill Creek Township, without yielding to oncoming traffic, causing the death of Donald E. Boal, 51 of Cooperstown. Boal was riding a motorcycle and was struck by Mazon’s vehicle. He was thrown from his vehicle and died of head trauma. According to an affidavit filed by police, Mazon admitted using marijuana earlier in the day. Mazon was also ordered to pay Boal’s funeral costs of $6,030.

Demetrius Newell, 35, of Spearman Avenue, Sharon, sentenced to 16 to 48 months in prison and ordered to make restitution for felony theft by unlawful taking and two misdemeanor counts, possession of a controlled substance and possession of drug paraphernalia. Newell was apprehended July 23, 2006, at a Mercer Avenue, Hermitage, address with a stolen Cadillac. He also had a small amount of marijuana and cocaine and some drug paraphernalia.

David Perna, 22, of Alderman Avenue, Sharon, sentenced to five to 11 months in the Mercer County Jail followed by two years’ probation for access device fraud. On April 20, 2007, he used a bank debit card issued to a family member without her authorization to obtain $300 from a MAC machine at Walgreen’s, 900 E. State St., Hermitage.

Brandon Ross, 28, of Bechtel Avenue, Sharon, placed on one year’s probation for criminal conspiracy/possession of a controlled substance. Ross was apprehended with cocaine May 23, 2005.

Richard Seelbaugh, 21, of Home Street, Mercer, sentenced to six to 12 months in the Mercer County Jail followed by one year’s probation for theft by unlawful taking or disposition. Seelbaugh stole an $800 digital DVD camera off another person’s desk at General Electric, 1503 W. Main St., Grove City, on Dec. 11, 2006.

Arthur Burns, 51, of Harrison Street, Sharon was sentenced to four to eight years in state prison for felony arson. He was also ordered to make $2,401 restitution to the Sharon Fire Department for the cost of using their equipment and personnel to put out the fire which he started at 728 N. Sharpsville Ave., Sharon on June 10, 2007. Burns, who had been drinking, intentionally started a fire in a first-floor bedroom of the house while at least five other people were in the residence. Firefighters arrived to find the house engulfed in flames. Those in the house managed to escape.

Bryant Hunter, 23, of Pittsburgh, was resentenced to 37 days to 23 months in the Mercer County Jail for fleeing and eluding, a misdemeanor. He had been placed on two years’ probation Aug. 29, 2006, for fleeing police officers in Shenango Township on Feb. 24, 2006.

Mark Kocis, 25, of Pine Hollow Boulevard, Hermitage, was sentenced to two to five years in state prison for burglary and conspiracy to commit theft by unlawful taking, both felonies. In February, 2007, he illegally entered Husnick’s Auto Clinic, 1500 E. State, Sharon, and stole a truck. He also stole a Jeep from a Dakota Street, Farrell, residence.

Roxanne Marich, 20, of West Main Street, Wampum, was placed on one year’s probation and ordered to make restitution for conspiracy to commit theft by unlawful taking, a misdemeanor. On Aug. 3, 2006, she conspired with a man to rob Pat’s Camera Cottage, 96 Creek Road, Springfield Township. Marich went in to the store first to make sure no one else was present and provided transportation to and from the robbery for her accomplice, who wore a mask and displayed a knife.

Damascus Savage, 29, formerly of Wallis Avenue, Farrell and now of the State Correctional Institute in Albion, was sentenced to four to eight years in prison for aggravated assault and possession with the intent to deliver cocaine, both felonies. On June 16, 2006, he deliberately struck another man with his automobile, knocking him to the ground in the 700 block of Idaho Street, Farrell. He was also apprehended June 3, 2006, on Emerson Avenue, Farrell with 632 grams of cocaine.

Richard Smith, 45, of South Mercer Street, Greenville, was sentenced to 111⁄2 to 23 months in the Mercer County Jail, followed by three years’ probation for felony burglary. He entered Damascus Tube, Brentwood Drive, Pymatuning Township on Nov. 29, 2006, and stole $2,000 worth of pipe.
