No trial date set in golf ball assault
WARREN – A trial date has not been set for a Howland man accused of using a golf ball to assault a Warren city prosecutor and his young son.
Visiting Judge Thomas Townley of Niles Municipal Court met Tuesday with Bradley J. Rushin, 46, of Howland Springs Road, who faces two misdemeanor assault charges; his attorney, Robert Shaker; and special prosecutor Terry Swauger, prosecutor in the Niles court.
Dates for another pre-trial hearing and trial will be scheduled later.
Rushin is accused of hitting a golf ball from the 17th hole at Old Avalon Golf Course at a June 30 birthday party being attended by Nick Graham, a city prosecutor, and his 3-year-old son, Jimmy. The party was being held at house off the 17th.
The case can’t be tried before the two Warren court judges and the other city prosecutor because of a possible conflict of interest.
