Man sentenced for 2 crimes


The defendant was jailed for more than two years before he pleaded guilty.

YOUNGSTOWN — A 23-year-old former Poland resident has been sentenced to 15 years in prison after he pleaded guilty to voluntary manslaughter in a Jan. 20, 2004, homicide, and to the April 10, 2005, aggravated robbery of a Boardman restaurant.

He also entered guilty pleas to a gun specification for each crime.

Judge Charles J. Bannon of Mahoning County Common Pleas Court imposed the sentence on Timothy A. Overman, giving him credit for 803 days he already has served in county jail awaiting the disposition of his case.

Overman entered his guilty pleas and the sentence was handed down as Overman was to go to trial Wednesday in the shooting death of Jason W. Gasior Jr., 23, in his East Midlothian Boulevard apartment. Police said the shooting likely stemmed from an argument over drugs or money.

Overman, who was indicted for murder in Gasior’s death in June 2005, pleaded guilty to the lesser charge of voluntary manslaughter and received a nine-year prison term for that offense, plus the mandatory consecutive three years for the gun specification linked to it.

Springfield Grille robbery

Overman also drew a nine-year prison term for the restaurant robbery to be served concurrently with the homicide sentence, plus the mandatory consecutive three-year gun specification for the robbery, bringing his total prison sentence to 15 years.

When Overman committed the robbery at 1 a.m., the Springfield Grille restaurant in Boardman had closed, but employees were still present.

The prosecution dropped the three kidnapping charges that were lodged against him for allegedly moving three employees elsewhere in the restaurant and the gun specifications that had been linked to those charges. Some $2,000 was taken in that robbery.

The man alleged to be the second gunman in the restaurant robbery, Chad Marshall, 28, of Clearmount Drive, awaits trial Sept. 12.
