Exemptions



EXEMPTIONS
The smoking-ban rules do not apply to certain private residences and family-owned operations, tobacco stores and nursing homes, though some restrictions apply. Eligible private clubs would have to meet these criteria:
Have no employees.
Are organized as nonprofit operations.
Only members are present in the building.
No one younger than 18 can be present.
Are located in free-standing buildings, and no smoke migrates to adjacent areas where smoking is prohibited.
If a club serves alcohol, it must hold a valid liquor permit.
