Man indicted in death of brother



WARREN -- A 46-year-old city man is indicted on a charge of voluntary manslaughter in the stabbing death of his brother.
Warren police charged Charles H. Smith Jr. of 1503 South Leavitt Road with the offense last week after he fought with his brother, Carl Smith, 28, of 806 Kinsman St. N.W., and his brother died.
David Toepfer, assistant Trumbull County prosecutor, said Smith Jr. could be sentenced to three to 10 years in prison or probation if convicted.
Police said the fight took place April 14 at the Kinsman Street address, where Carl Smith lived with his mother, two other brothers and Charles Smith Jr.'s son.
Smith Jr. had also lived in the home but had been ordered out of the house because of his lifestyle, including drug addiction, Warren Detective Jeffrey Hoolihan said.
Smith Jr. was also injured in the fight and was treated for head and face wounds.
When police arrived at the home just after midnight, they found Smith Jr. in the living room in a semi-conscious state, while Carl Smith was lying on the dining room floor with several stab wounds of the chest and abdomen. A kitchen knife was found next to the dead brother.
Smith Jr. will be arraigned at 11 a.m. May 2 before Trumbull County Common Pleas Court Judge W. Wyatt McKay.
