Lawsuit targets county officials and truck driver



YOUNGSTOWN -- Mahoning County officials and a truck driver are being sued over the April 2005 death of a county engineer's office worker.
Robert E. Tablack of Austintown, administrator of the estate of Edward J. Popovich, filed a wrongful-death suit Tuesday in common pleas court against county commissioners, the county engineer's office, Engineer Richard A. Marsico, Michael Cvengros of Campbell, four John Does and their unidentified political subdivisions.
A crew from the engineer's office was filling potholes on Sharrott Road in Beaver Township when Popovich, 50, of Struthers, was pinned between two dump trucks.
Tablack's suit identifies Cvengros as the driver of the rear dump truck and accuses him of acting recklessly. County officials were included because they required employees to work under dangerous circumstances, the suit states.
The suit seeks compensatory and punitive damages in excess of $25,000, plus attorney's fees. The case has been assigned to Judge Maureen A. Cronin.
