Boardman Sam's Club sued over wet floor
YOUNGSTOWN -- A Boardman woman and her husband sued Sam's Club on Tuesday over injuries she suffered in a fall at the club.
Emilie Gangale attributed her fall to water that had dripped onto the club's concrete floor from wet buggies club personnel had negligently brought into the store.
Gangale, of West Parkside Drive, and her husband, Dominic, sued the club at 6361 South Ave., which is a division of Wal-Mart Stores Inc., and several John Doe enterprises, over her fall, which occurred while she attempted to obtain a buggy as a club customer July 26, 2004.
The defendants failed to remove the water from the floor or warn patrons the floor was wet and slippery, according to the suit, which demands a jury trial.
Gangale said she suffered permanent and disabling injuries to her head and entire left side and fractured a finger on her left hand, received medical and hospital care and will require such care in the future and lost work time and wages.
Gangale and her husband each seek in excess of $25,000 in damages in the suit filed by Attys. Angela J. and Thomas L. Mikulka of Austintown.
Wal-Mart officials did not return a call seeking comment.
