Judge denies request
Judge denies request
AKRON -- A judge has again denied Damian Bradford's request to have his cellular telephone records barred from his upcoming trial. U.S. District Judge David Dowd issued a formal order Wednesday. The judge had denied the same request last week, but Bradford's attorneys asked the judge to reconsider it in light of the Wireless Communications Act, which says a person must authorize the release of their telephone records. Judge Dowd said it does not apply in this case. Prosecutors intend to use Bradford's cellular telephone records at trial to show he stalked Dr. Gulam Moonda. They contend the records of May 13, 2005, show Bradford near his Beaver County home, then in Hermitage, Pa., near the Moonda home, and then near the Ohio Turnpike where Moonda was killed.

Hughes' hearing is scheduled today in Mahoning County Court here.
