Man names engineer, resident in lawsuit



WARREN -- A Liberty man is suing the Trumbull County sanitary engineer and a property owner who entered into a private sanitary sewer agreement, over problems with the sewer line.
John J. Masternick, of 2200 Arms Drive, filed the lawsuit Thursday in Trumbull County Common Pleas Court. It names among defendants the sanitary engineer and Katherine Pompeii, 9611 Market St., North Lima.
The suit says Pompeii entered into a contract with the county March 27 to build an 80-foot sewer line on Arms Drive. The suit says there are two problems with this line.
The first problem is that it will be elevated more than 12 feet above a creek bed known as Crab Creek. The line will be a nuisance and safety concern and will damage the value of Masternick's property, the suit says.
The suit also says the line violates the engineering requirements of the county, which require sewer lines have a minimum fall of one-eighth inch per lineal foot with permission. This sewer line has a fall of less than one-eighth inch per lineal foot, the suit says.
The suit asks the court to declare the sewer line a nuisance and that the defendants be stopped from building the line.
