Deputies plead innocent in case



The three are accused of failing to arrest a former auxiliary deputy.
WASHINGTON COURT HOUSE, Ohio (AP) -- Three deputy sheriffs pleaded innocent to charges accusing them of failing to arrest a former auxiliary deputy who authorities said vandalized his home and later killed his wife and himself.
Ernest Jackson Jr., Terry Olsen Jr. and Patricia Bailey have been charged with dereliction of duty, accused of failing to stop Bailey's brother, John Bailey, from vandalizing his home and arrest him Oct. 25.
Their innocent pleas were entered Wednesday in Fayette County Common Pleas Court, where they are scheduled for trial in February.
Dereliction of duty, a misdemeanor, is punishable by up to 90 days in jail.
Jackson and Olsen had gone to Bailey's home to serve a civil protection order sought by his wife, Lori.
The order required him to leave the home and for deputies to seize any guns, Fayette County Sheriff Vernon Stanforth said.
Sister interfered
Patricia Bailey, who was off duty and called to the home by her brother, interfered with Jackson and Olsen as they tried to inventory the guns in the house and stopped them from removing all the guns, Stanforth said.
Bailey then smashed windows in the house, ripped out wiring, knocked over furniture and painted walls, while the deputies were present, authorities said.
Bailey was charged the following day with violating the protective order and damaging the home.
Murder-suicide
He kidnapped his wife from the home of their children's baby sitter Nov. 1, fatally shot her in a rural barn and then killed himself, authorities said.
There is no connection between the delay in John Bailey's arrest and the murder-suicide, Stanforth said.
The Franklin County sheriff's office reviewed the conduct of Stanforth's deputies, who have been placed on paid leave. An administrative hearing will determine possible disciplinary action, Stanforth said.
Washington Court House is about 40 miles southwest of Columbus.
