Sentencing set in endangering
YOUNGSTOWN -- Sentencing for an Austintown woman charged with child endangering will be at 9:30 a.m. Jan. 12 before Judge R. Scott Krichbaum of the Mahoning County Common Pleas Court.
Tiffany Bungard, 36, pleaded no contest Wednesday in Judge Krichbaum's court.
Prosecutors said Bungard was sitting in a parked car Aug. 9 and did nothing to remove her 6-year-old daughter from the car when the a man in the car injected himself with heroin.
Prosecutors said Bungard was in the front passenger seat and the man in the driver's seat. The 6-year-old was in the back seat and not restrained in a child safety seat.
Because the child was unrestrained, prosecutors argued she was in danger because she was only a few feet away from the heroin and could have come in contact with it if she had reached over the seat.
Bungard was convicted of child endangering in 2002 -- a second-degree misdemeanor charge, prosecutors said. The current charge was elevated to a third-degree felony because of the prior conviction, they said.
