Judge sentences 2 men to prison
Both men will be on parole after they get out of prison.
YOUNGSTOWN -- Judge R. Scott Krichbaum of the Mahoning County Common Pleas Court sentenced two Youngstown men to prison Wednesday.
Eddie Winphrie, 33, of East Boston Avenue, will spend 10 months in prison and then serve up to three years of post-release control for receiving stolen property and tampering with the identifying number to conceal the identity of a vehicle.
According to the indictment, Winphrie received a car May 5 he knew was stolen and then altered its vehicle identification number. Winphrie receives credit for four months of jail time served.
Judge Krichbaum also sentenced Rodney Clay, 36, of Chicago Avenue, to three years in prison and up to three years of post-release control on a charge of felonious assault. Prosecutors said they would not object to early release, which Attorney Louis Defabio said he would apply for on Clay's behalf in six months.
About second case
According to the indictment, Clay caused serious physical harm to a woman Sept. 9. Defabio said Clay had been drinking all day and taking medication when he and the woman began to argue. The argument escalated into a fight.
Clay was originally charged with felonious assault, kidnapping and domestic violence. Prosecutors dropped the other charges and Clay pleaded guilty to felonious assault.
Judge Krichbaum told Clay that "nobody should be beating up a woman ... you are a strong, healthy-looking guy. Beating up a woman who obviously could not defend herself is inexcusable."
Judge Krichbaum told Clay that he needs to learn not to drink. Some people become silly when they drink, while others become angry, and apparently Clay is in the latter group, Judge Krichbaum said.
Clay receives credit for 163 days served in jail. Defabio said if Clay had been convicted by a jury of kidnapping, felonious assault and domestic violence, he could have received up to 191/2 years in prison.
