Two men sentenced in death of informant
CLEVELAND (AP) -- Two men convicted of kidnapping an FBI informant who was killed accidentally by an agent were sentenced Thursday to life in prison.
Judge Michael Donnelly of Cuyahoga County Common Pleas Court sentenced Aubrey Waller, 24, and Gary Ervin, 23, both of Cleveland, a day after a jury convicted them on charges of murder, kidnapping, felonious assault resulting from a shooting Dec. 23, 2003, in which Darnell Lester was killed.
Waller and Gary Ervin kidnapped Lester, 26, at gunpoint and demanded money.
Lester told them he would call a drug dealer to get cash and drugs, but the call went to his FBI handler in New York. A short time later, FBI agents surrounded the car they were in. Ervin's vehicle rammed two vehicles and he drove at an agent, who fired his assault rifle and hit Ervin and Lester.
