Man sentenced in rape case, given possibility of parole



YOUNGSTOWN -- A Lowellville man was sentenced Monday to life in prison with the possibility of parole after 10 years for raping a 9-year-old girl.
Mahoning County Common Pleas Court Judge James C. Evans sentenced John W. Daniels, 35, of Washington Street, Lowellville, in the Feb. 19, 2004, rape. Daniels pleaded guilty in March to the charge of raping a girl under 13 by threat of force.
The judge accepted the recommendation from the prosecutor's office that Daniels serve the life sentence with the possibility of parole after he serves 10 full years.
A plea agreement removed language that would have given Daniels life imprisonment without parole.
Daniels also pleaded guilty Feb. 28 to a child-rape charge in Trumbull County Common Pleas Court, and he also was sentenced to 10 years to life in that case. Judge Evans ruled his sentence would be served concurrently with the Trumbull sentence.
Daniels also will be designated as a sexual predator, which means he must register with the sheriff in the county where he lives every 90 days for the rest of his life if he is released from prison. The sheriff then will notify the community in what neighborhood Daniels lives.
