Judge puts one man in prison, frees another

YOUNGSTOWN -- Two men who faced Judge R. Scott Krichbaum for sentencing in separate cases suffered different fates. One is going to prison; the other will get a chance to get his life in order.
Judge Krichbaum of Mahoning County Common Pleas Court sentenced Joshua Davis, 22, of Carroll Street to a year in prison on a charge of aggravated assault.
Davis was indicted last year on a charge of felonious assault of a city woman July 29. He pleaded guilty to the reduced charge of aggravated assault late last year.
Todd Olivo, 31, of Winchester Avenue, also appeared for sentencing on two counts of receiving stolen property. He could have faced three years in prison on both charges.
Olivo was charged with receiving stolen merchandise last year from two used-car businesses. He has since made restitution.
The prosecutor's office and the Ohio Adult Parole Authority both recommended Olivo receive probation.
Olivo's lawyer said his client has a job waiting for him if the judge granted probation.
Judge Krichbaum placed Olivo on three years' probation, with the provision he complete a substance abuse program and parenting skills class through Community Corrections Association.
He said Olivo has a chance to start a new life with his young daughter. He reminded him, however, that if he violates any aspect of his probation, "I will put you in the penitentiary for three years."
