Zoning appeals board revokes permit



MINERAL RIDGE -- Weathersfield Township Board of Zoning Appeals voted 5-0 Thursday to revoke a permit it had issued in June 2003.
Township Administrator David Pugh requested the permit be overturned.
At question was the height of a fence going down the sides of a residential property owned by Tim and Cheryl Luman, 1688 Rosalyn Circle.
They constructed a fence 6 feet high along the sides of their property but have not reduced the height of the fence to the required 3-foot height on one side of the house, where it extends past the house. This issue had caused the Lumans to unsuccessfully seek a variance from the zoning board.
The township zoning office is suing the owners, and a hearing is tentatively set for Jan. 25 in Niles Municipal Court.
The zoning department has attempted to have the couple take down 16 feet of fence if they won't cut the height from 6 to 3 feet and replace it with shrubbery.
In another matter, the board approved a request for a variance on the required 50-foot setback to build a single-family home at 3862 Meander Drive.
Eugene and Geri Senczyszak requested a setback of 46 feet to build a home with an attached garage. Only the garage will be 4 feet below the required setback.
