Warren man wouldn't face death penalty
WARREN -- A Warren man charged with aggravated murder in the Oct. 22 shooting death of Angeline Lavine, 37, of Scott Street Northeast, will no longer face the death penalty if convicted.
David Nolan Hollie, 26, of Porter Street Northeast, made an appearance in Trumbull County Common Pleas Court on Wednesday before Judge W. Wyatt McKay. His next hearing is set for Dec. 21, and his trial is set for Jan. 17.
Earlier in the week, prosecutors dropped the capital murder specifications in the case. Hollie now faces the possibility of life in prison without parole, but not the death penalty.
The prosecutor's office said the capital murder specifications were dropped after reviewing the case further.
According to court documents, Hollie went into a residence at 422 Summit St. carrying a small pistol and shot Lavine, who was seated in a chair, in the head. He then took a revolver, purse and drugs from Lavine.
He fled the scene and hid the guns outside of 171 Belmont N.W. and went to 211 Porter St. N.E. and changed clothes, the documents state.
He is being held in the Trumbull County Jail on a $2 million bond.
After interviewing witnesses and conducting a preliminary investigation, police said they arrested Hollie at his residence within an hour after the shooting. Hollie was initially jailed on a felonious assault charge, but the charge was increased to aggravated murder after Lavine died.
