Judge accepts suspect's requests to waive hearing, drop charges

YOUNGSTOWN -- A South Side man charged with murdering his brother waived his right to a preliminary hearing Friday, and had the case bound over to a Mahoning County grand jury.
Elbert Schuler remained silent as municipal court Judge Robert P. Milich accepted his attorney's request to waive the hearing.
The 42-year-old, of 37 Cleveland St., remains in Mahoning County jail, in lieu of $150,000 bond.
Judge Milich also accepted prosecutors' requests to drop two previous misdemeanor traffic charges at the hearing.
Schuler is accused in the Aug. 10 killing of his brother, 40-year-old Harold Schuler, of the same address, who was found shot to death on Falls Avenue.
Police have said Harold Schuler was shot with a .38-caliber revolver during a "family feud."
No explanation has been given as to why Harold Schuler was on Falls Avenue.
Anthony Farris, chief assistant city prosecutor, has said the brothers were arguing about money and that alcohol was involved.
Harold Schuler was the city's 21st homicide victim this year, and three other men have been killed since his death.
