Grand jury indicts man in crash that killed 6
The man tested positive for alcohol and drugs after the accident.
PORT CLINTON, Ohio (AP) -- A driver who authorities say started a chain-reaction accident that killed six people in June has been indicted on 12 counts of aggravated vehicular homicide, a county prosecutor said.
The Ottawa County grand jury's indictment against Brian Woody, 29, of Toledo, includes six counts of aggravated vehicular homicide that charge Woody was under the influence of drugs or alcohol at the time, all second-degree felonies.
Six other counts of aggravated vehicular homicide charge that Woody was reckless, all third-degree felonies, said prosecutor Mark Mulligan.
He also was indicted on charges of aggravated vehicular assault and attempting to leave the scene of an accident.
Woody pleaded innocent to the charges during an initial appearance Friday in common pleas court.
Test results
After the accident, Woody tested positive for small amounts of marijuana, valium and alcohol. Authorities, though, did not say whether they thought those substances impaired his ability to drive.
Tests showed that Woody's blood-alcohol was 0.025 percent, which was below the legal limit of 0.08 percent.
Mulligan said the indictment was delayed because prosecutors were waiting for toxicology reports, which allowed the grand jury to find probable cause Woody was driving under the influence despite his blood alcohol content being below the legal limit.
Woody told police he had two beers at Cedar Point amusement park about nine hours before the accident June 21 near Lake Erie.
Six people from the Detroit area were killed while on their way home from the park in Sandusky.
The accident began when the Blazer that Woody was driving went left of center and struck a tractor-trailer, causing the semi to hit a Cadillac Escalade and another car, the patrol said.
The victims, including the driver, his two daughters and his niece, were in the Escalade, which landed upside down in a creek.
According to the crash report, Woody told officers he didn't drive left of center and was sideswiped by the tractor-trailer.
A message was left seeking comment early Saturday at the office of Woody's lawyer, Adrian Cimerman.
