Udderly Smooth owners sue company over product
LISBON -- Redex Industries Inc. of Salem, which makes Udderly Smooth skin moisturizing lotion, is suing a company for trademark infringement, unfair competition and deceptive trade practices.
The lawsuit was filed this week in Columbiana County Common Pleas Court against Cut-Heal Animal Care Products of Cedar Hill, Texas.
Redex says it has sold its lotion since 1977, and since at least 1992 put it in packaging with black-and-white cow spots. Redex said it has owned a U.S. Trademark Registration of the name and design since 1997.
Cut-Heal is allegedly selling a skin moisturizing lotion with the designation of Udder Delight with black-and-white cow spots on the packaging. Redex wants Cut-Heal barred from using the similar name and packaging and to pay an unspecified amount of damages.
