ZONING VIOLATIONS Brothers fined for illegal junk yard



The area was littered with about 130 junk vehicles.
NILES -- Two brothers who illegally operated a salvage yard in Weathersfield Township were ordered to pay a daily fine until the area is cleaned up.
Lance E. Irwin and Leo W. Irwin III, no ages available, both of Rhiems Avenue, appeared Friday in Niles Municipal Court.
They were cited into court by township Zoning Inspector Sherri Craver for operating the salvage yard at 2539 W. Liberty St. Court documents show the area was littered with about 130 junk vehicles.
Original fine
At that time, Judge Thomas W. Townley ordered each man to pay a $100 fine for each day the salvage yard operated but suspended the fine provided the area was cleaned up.
Records show Lance Irwin was found guilty of 152 days of operation, and Leo Irwin was found guilty of 112 days of violation.
After zoning officials noted the area was still not cleared, the men were ordered back into court. The men said they were able to remove about 100 vehicles from the site, but another 30 vehicles remain.
Judge Townley declined to reinstate the original fine, which would have amounted to hundreds of thousands of dollars for each man. He did, however, order the brothers to each pay $100 Friday, and to return Monday to pay another $200 for today and Sunday.
If the area is not cleared, the men will continue to be fined $100 per day until all of the vehicles are removed.
