Family sues Brookfield store in alcohol-related death of minor



YOUNGSTOWN -- The family of a Pennsylvania minor killed in a 1998 traffic accident is suing the Brookfield Drive-In, accusing it of selling him alcoholic beverages.
The lawsuit was filed Friday in U.S. District Court, Youngstown, by Joan McCauley, representing the estate of Todd McCauley. It asks for at least $75,000 in damages from the business, located on Irvine Avenue in Masury. The suit says Joan McCauley lives in Pennsylvania, but it does not say where.
The lawsuit says Todd McCauley and two other minors were "noticeably intoxicated" when they bought alcoholic beverages at the Brookfield Drive-In on Saturday, Nov. 7, 1998. On Sunday, Nov. 8, 1998, they were involved in an accident in which one of the other teens was driving and McCauley was killed.
The lawsuit does not say how old McCauley was at the time or where the accident happened. A man who said he was manager of the drive-in declined to comment Tuesday.
Atty. Joseph Rafidi said a lawsuit had been filed previously but was unsuccessful because of "discrepancies" over who should have been named as defendants.
