MAHONING COUNTY Sex offender to finish sentence



The 63-year-old man is getting out of prison and going to the county jail.

YOUNGSTOWN -- Frank Wilczynski had one simple request when he stood before Judge Maureen A. Cronin Tuesday in Mahoning County Common Pleas Court.
"Let me out," he said, explaining that he wanted to get out of prison early so he can go home and help his wife pay bills.
The judge let Wilczynski out of prison, but the 63-year-old Youngstown man will still be behind bars. Judge Cronin ordered him to serve the remaining 10 months of his three-year prison sentence in the county jail.
Wilczynski was sentenced in November 2003 after he'd pleaded guilty to one count of gross sexual imposition. He admitted fondling an 11-year-old girl at the West Dennick Street home where he lived in January 2002.
Defense attorney Damian Billak had filed a motion asking Judge Cronin to revisit the sentencing and place Wilczynski on probation. Including time spent in the county jail awaiting trial, Wilczynski has been incarcerated 26 months, Billak said.
He said Wilczynski has no other criminal record and has no history of sexual abuse. Wilczynski's extremely low IQ classifies him as mentally retarded, Billak said.
Opposed probation
Assistant Prosecutor Dawn Krueger opposed probation for Wilczynski but said she did not mind his being returned to Youngstown and finishing his sentence in the county jail.
Wilczynski's wife, Louise, said she loves her husband and wants him to come home. She promised to keep him away from the victim.
"There can never be juvenile girls in your house again," the judge told Mrs. Wilczynski. "He can never be alone in the house with juvenile girls."
As part of his plea agreement, Wilczynski agreed to being labeled a sexually oriented offender. That means that when he gets out of jail, he must register his address with the sheriff of the county in which he lives. He must register once a year for 10 years.
