OHIO RIVER 5 men sue owner of speedboat in collision that led to injuries

DAYTON, Ky. (AP) -- Five men injured when two boats collided on the Ohio River have filed a lawsuit against an Ohio man indicted in the crash.
Brian Maher, whose small pleasure craft was run over by a larger speedboat, and four of his friends filed the suit in Campbell Circuit Court against Glenn Colann and several others.
Colann, a car dealer from the Columbus suburb of Gahanna, is awaiting trial on four counts of first-degree assault, seven counts of first-degree wanton endangerment and three counts of fourth-degree assault. He has pleaded innocent and is free on bond.
The civil suit also names as defendants Kathy Lytle and Michael Zang, both of Villa Hills, and Steve Gott of Covington, who were passengers on the speedboat. Ludlow Bromley Yacht Club Inc., a riverside restaurant accused of serving the defendants alcohol, also is named.
None of the defendants could be reached for comment. The lawsuit asks for unspecified damages.
Colann's attorney, Jim Morgan, has disputed the prosecution's claim that Colann's speedboat was involved in the crash.
What's alleged
Prosecutors say Colann's 40-foot Baja Outlaw speedboat struck Maher's 20-foot pleasure boat June 27, 2003, from behind and sped away. Seven people were on Maher's boat when the collision happened.
Other plaintiffs are Stephen Abernathy of Kings Mills, Ohio; Douglas Howard of Cincinnati, William Wright of Waterford, Mich.; and Tom Bocson of Troy, Mich.
