Judge upholds prison sentence for sex offender



YOUNGSTOWN -- Judge Theresa Dellick has upheld the prison sentence for Brian Dudek, 17, who admitted to sexually assaulting six children younger than 8 at his mother's Austintown home day-care business.
The judge issued a written ruling Wednesday in Mahoning County Juvenile Court stating that the sentence complies with state law "in that the community is protected and the offender is held accountable."
Dudek pleaded guilty in February in juvenile court to six counts of felony gross imposition, and in April, Magistrate Donna McCollum recommended Dudek spend a minimum of three years in a state juvenile prison.
If Dudek serves the maximum, he will be in prison until he is 21.
He was arrested for assaulting the children in September 2003.
Atty. Gary Van Brocklin, who represents Dudek, argued before Judge Dellick earlier this month that the sentence should be overturned because Dudek has not received counseling and medical care while in juvenile prison.
Dudek was sent to prison based on McCollum's recommendation, but Judge Dellick has final say over the sentence.
Assistant County Prosecutor Anissa Jones said Judge Dellick told attorneys Wednesday that according to the state, Dudek is receiving counseling in prison.
