Boy won't be charged in death of infant



HAMILTON, Ohio (AP) -- A 5-year-old boy will not be prosecuted in the death of a 6-week-old baby earlier this week, prosecutors said.
"We must be careful not to compound a tragedy by wrongfully putting a 5-year-old child into the justice system. Two wrongs don't make a right," Butler County Prosecutor Robin Piper said Friday.
The Hamilton County coroner's office has said that Cardasia Goens died from a crushing injury to her skull. According to authorities, Cardasia's mother was baby-sitting the 5-year-old Tuesday at the apartment complex where both families lived.
The mother was not in the apartment with the baby at one point but went upstairs when she heard the Cardasia crying and discovered she had been injured.
Piper said the 5-year-old, "acknowledged to detectives his role in physically abusing and mistreating" Cardasia. There was no indication that the boy was an abused child or had acted out in the past, she said.
Authorities said they do not plan to file charges against any adults in connection with the baby's death.
Ohio does not allow for a 5-year-old to be criminally charged. An emergency court order was filed Friday requiring the boy to undergo a psychological evaluation to determine whether he needs counseling.
