TRUMBULL COUNTY Insurance carrier faces suit over Liberty wreck
The driver was sentenced earlier this year to 18 months in prison.
WARREN -- A Girard couple struck by another motorist two years ago in a Liberty grocery store parking lot has sued their insurance company in Trumbull County Common Pleas Court.
Atty. J. Gerald Ingram filed the lawsuit Thursday on behalf of Nancy A. and Robert Norman of Patricia Drive against State Farm Mutual Automobile Insurance Co., which is based in Newark, Ohio.
In July 2002, the Normans' car was struck by an SUV driven by Anthony V. Ciminero while in the parking lot of the Belmont Avenue Giant Eagle. Nancy Norman was then run over by Ciminero's vehicle and "suffered severe and debilitating injuries to her entire body" which are permanent and "will restrict her activities for the rest of her life," according to the lawsuit.
Nancy Norman incurred medical expenses exceeding $250,000.
No insurance
Ciminero's insurance company, Mid-Century Insurance Co., has denied coverage for the accident.
Because of that denial, the lawsuit contends, Ciminero was an uninsured motorist at the time of the accident and the Normans are entitled to recover uninsured/underinsured motorist benefits under their policy. The company hasn't paid those benefits.
Brian Maze, a State Farm spokesman, declined to comment because it's a pending legal matter.
The case has been assigned to Judge W. Wyatt McKay.
Ciminero was sentenced last March to 18 years in prison after pleading guilty to one count each of vehicular assault and aggravated possession of drugs and two counts of drug possession.
The Normans have a civil lawsuit against Ciminero pending in court.
